When an Uncontested Divorce Is the Right Path

An uncontested divorce is the fastest, most affordable way to end a marriage—when you both agree on the terms.

🤝

You Both Agree

You and your spouse have reached agreement—or are close—on property, debts, custody, parent-time, and support. No courtroom battle needed.

💰

You Don't Want to Overpay

A traditional contested divorce can cost thousands per side. When it's uncontested, you shouldn't pay hourly rates for paperwork.

📝

You Want It Done Right

Utah courts reject incomplete or incorrect filings. A licensed attorney reviews every document so your decree is accepted the first time.

Every Document Utah's Courts Require

An uncontested divorce isn't one form—it's a packet of interlocking documents that all have to agree with one another. We prepare the complete set, tailored to whether you have minor children and shared property.

📄

Core Filings

Petition for Divorce, summons and acceptance of service, your settlement agreement / stipulation, and the proposed Decree of Divorce with findings.

👪

If You Have Children

A parenting plan, child support worksheets calculated to Utah's guidelines, and the supporting orders the court needs to finalize custody and support.

📊

Financial & Final Paperwork

Financial declarations, vital-statistics forms, and clear, court-specific instructions for filing and finalizing—including the mandatory courses and 30-day waiting period.

90 day residency
At least one spouse must have lived in Utah for 90 days before filing
30 day waiting period
Utah's mandatory waiting period before a decree can be finalized (waivable for good cause)
100% attorney-reviewed
Every document reviewed, refined, and approved by a licensed Utah attorney

Uncontested Divorce Flat-Fee Pricing

One flat fee, no hourly surprises—every package prepared and reviewed by a licensed Utah attorney, not a form-filling website. A traditional Utah divorce attorney typically runs $1,083–$3,825 all-in, while DIY form sites leave you with no real legal review. We sit in between.

Included in Every Package

  • All documents your case requires, drafted for Utah courts
  • Review by a licensed Utah attorney before delivery
  • A one-on-one intake consultation
  • One round of revisions
Tier 1
Draft & Guide
We draft every document your case needs and give you clear, step-by-step instructions to file with the court yourself.
No minor children $749
With minor children $999

Optional Add-Ons

  • Real property deed transfer (quitclaim / warranty) — $150
  • Additional revision round — $75
  • Expedited turnaround (documents within 7 days) — $150
  • Retirement / pension division (QDRO) — quoted separately

Flat fees cover document preparation, and filing on Draft & File, for an uncontested matter. They do not include the Utah district court filing fee of $325 (paid to the court); cases with minor children also require a $65-per-parent divorce education course. If your case becomes contested or needs work beyond the flat scope, that additional work is billed at $300/hour, disclosed up front. Final pricing depends on the complexity of your case.

Uncontested Divorce Questions

Common questions about getting an uncontested divorce in Utah.

What makes a divorce "uncontested"?

+
A divorce is uncontested when you and your spouse agree on all of the terms—how property and debts are divided, and (if you have children) custody, parent-time, and support. If you agree on most things but are stuck on a few, we can often still help you document the agreement once those points are resolved.

How long does an uncontested divorce take in Utah?

+
Utah has a mandatory 30-day waiting period from filing before a decree can be finalized, and the court can waive it only for good cause. With an uncontested case and complete paperwork, many divorces finalize within 30–90 days. If you have minor children, you'll also need to complete the required divorce orientation and parenting courses.

Do I have to go to court?

+
In many uncontested cases in Utah, you can finalize by affidavit without ever appearing in court. If your case does require a hearing, we'll let you know early and walk you through exactly what to expect. We'll confirm which path applies to your case during the consultation.

What are the Utah residency requirements?

+
At least one spouse must have been a resident of Utah—and of the county where you file—for at least 90 days before filing. If children are involved, additional jurisdictional rules may apply, which we'll review with you.

What if we have children together?

+
When minor children are involved, your packet includes a parenting plan and child support worksheets calculated under Utah's guidelines, and both parents must complete the mandatory divorce orientation and parenting courses. We prepare all of the child-related documents and explain the course requirements.
